If you feel that a fellow Tunespeaker is tampering with the entry processes, please alert us at support@tunespeak.com with the appropriate details at least 24 hours before the end of the Tunespeak sweepstakes/contest/raffle in which he/she is participating and we will do our best to look into the authenticity of his/her activity. Tunespeak does not directly address inquiries regarding suspected inauthentic behavior within 24 hours from the close of a sweepstakes/contest/raffle, as well as any requests after the close of a sweepstakes/contest/raffle.
Any other attempted form of entry is void. Online entries must be received and recorded by the Sponsor's computer during the Sweepstakes Period. No responsibility is assumed by Sponsor for lost, late, illegible, incomplete, stolen, postage-due, mutilated, non-delivered or misdirected entries or mail. Submissions become property of the Sponsor, and none will be returned. Unlimited entries per person/email address/account per day, regardless of entry method. Prizes won by an eligible entrant who is a minor in his/her jurisdiction of residence will be awarded to minor's parent or legal guardian who must sign and return all required documents. Winner may not be drawn for a Prize in a Tunespeak promotion more than three (3) times in a ninety (90) day period. If a prize is a associated with a concert or show, a winner may not win more than one prize per concert or show. A winner may not win prizes exceeding two thousand five hundred dollars ($2,500.00 USD) in a three hundred and sixty-five (365) day period.
Tickets are subject to the terms and conditions set forth thereon and all applicable venue, Artist, and Sponsor policies. Location of seats shall be determined in Sponsor's sole discretion.
Winner is solely responsible for any and all items and expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to ground transfers between winner's residence and airport of departure, ground transportation while in destination city (other than as specified in the prize description), in-room charges (e.g., mini-bar, room service, telephone, movies), meals and beverages, gratuities, travel upgrades, baggage fees, and personal incidentals. Winner(s) and/or guests will be required to provide a valid major credit card or some other acceptable form of payment, as determined in the hotel's sole discretion upon hotel check-in and all in-room charges, telephone calls, meals, beverages, hotel upgrades, amenities, personal incidentals and any other expenses charged to the winner's hotel room will be charged to that major valid credit card or deducted from the deposit provided. The ARV of the prize may vary based on the commercial airport nearest winner's permanent residence, as well fluctuations in hotel room rates at the time of travel. Winner(s) and guests must travel on the same itinerary and on dates designated by Sponsor. In the event the winner(s) or guests cannot travel on dates designated by Sponsor, winner(s) may be disqualified and the prize may be awarded to an alternate winner in a random drawing from among all remaining eligible entries provided sufficient time remains prior to the trip. If winner(s) or guests are deemed a minor under the jurisdiction of his/her state/province or territory of residence, such winner or guest must be accompanied by a parent or legal guardian throughout the trip. If the winner(s) becomes disabled or cannot otherwise fully enjoy the prize due to illness, Sponsor shall have the option at its sole discretion of being relieved of liability for fulfillment of the prize award, and no other compensation in lieu of the prize will be awarded. Total ARV of all prizes: $2,185 USD/$3,000.00 CAD. If winner cannot accept the prize as stated, prize will be forfeited and awarded to an alternate winner. No substitution, cash redemption or transfer of prize permitted. However, Sponsor reserves right to substitute prize with prize of equal or greater value if advertised prize becomes unavailable. BINDING ARBITRATION: Except where prohibited by law, any controversy or claim arising out of or relating to this Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS ("JAMS Rules and Procedures") then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. Les comptes étant inactifs ou affichant une activité minime peuvent aboutir à l’identification du compte comme étant faux. Vous ne gagnerez pas de bons (et votre compte peut être suspendu) sur Tunespeak si vous utilisez un faux compte afin de gagner des bons pour vous-même. Il s’agit, encore une fois, d’un exemple de faux fan n’étant pas autorisé comme il est stipulé dans nos Conditions de Service.

Forums ou Pages « Obtenir des Votes pour le Concours » : Le Promoteur surveille les forums/pages populaires qu’il a identifiés et considérés comme étant faux. Si vous avez connaissance d’un forum/page qui est dédié à l’obtention de votes pour les concours, veuillez nous en informer à support@tunespeak.com et nous nous efforcerons de le surveiller à la recherche de toute fausse activité Tunespeak. Si vous suspectez qu’un membre de Tunespeak viole les processus d’obtention des bons, veuillez nous en informer à support@tunespeak.com avec les informations détaillées au minimum 24 heures avant la fin du concours publicitaire/loterie/tombola Tunespeak auquel il/elle participe et nous nous efforcerons de vérifier l’authenticité de son activité. Tunespeak ne répond pas directement aux demandes relatives aux suspicions de comportements frauduleux après 24 heures suivant la fin d’un concours publicitaire/loterie/tombola, ni à aucune demande après la fin d’un concours publicitaire/loterie/tombola.
Toute autre tentative de participation est nulle. Les participations en ligne doivent être reçues et enregistrées par l’ordinateur du Promoteur durant la Période du Concours. Les personnes qui violent ou abusent d’un quelconque aspect du présent Concours Publicitaire ou tentent autrement de saboter le fonctionnement légitime du Concours Publicitaire en trompant, piratant, rusant, ou toute autre pratique de jeu déloyale ou ayant pour intention d’ennuyer, d’abuser, de menacer ou de harceler un quelconque autre participant ou les représentants du Promoteur, à la discrétion du Promoteur, seront disqualifiées. Le Promoteur se réserve le droit, à sa seule discrétion, d’annuler ou de suspendre le présent Concours Publicitaire en cas de fraude, virus, bogues ou autres causes échappant au contrôle du Promoteur mettant en péril l’administration, la sécurité et le bon déroulement du Concours. Toute utilisation de méthodes de participation robotiques, automatiques, macros, programmées ou similaires annulera toutes les participations par ces méthodes, et disqualifiera tout participant utilisant de telles méthodes. ARBITRAGE CONTRAIGNANT : Sauf si la loi l’interdit, toute controverse ou réclamation découlant de ou en rapport avec le présent Concours Publicitaire doit être réglée par un arbitrage contraignant dans un lieu déterminé par l’arbitre tel qu’indiqué dans les présentes (dès lors que ce lieu est raisonnablement approprié pour le demandeur), ou en tout autre lieu tel que pouvant être mutuellement convenu par les parties, conformément aux règles de procédure pour les litiges commerciaux stipulées dans les Règles et Procédures Exhaustives d’Arbitrage de JAMS (« Règles et Procédures de JAMS ») alors en vigueur, et le jugement sur la sentence rendue par le ou les arbitres peut être exécuté dans tout tribunal compétent. L’arbitre sera sélectionné en vertu des Règles et Procédures de JAMS. L’arbitre doit appliquer le droit du Missouri conformément à la Loi Fédérale sur l’Arbitrage et à toutes les lois applicables en matière de limitations, et doit respecter les demandes de privilège reconnues en droit. Si le demandeur peut démontrer que les frais d’arbitrage seront rédhibitoires par rapport aux frais du litige, le Promoteur paiera les frais de dépôt et d’audience du demandeur concernant l’arbitrage comme l’arbitre le juge nécessaire pour éviter que l’arbitrage soit rédhibitoire en matière de coûts. Si une quelconque partie de cette disposition d’arbitrage est jugée comme étant invalide, inapplicable ou illégale (à l’exception des réclamations qui ne seront pas arbitrées selon une base collective ou par représentation), ou est autrement en conflit avec les règles et procédures établies par JAMS, alors le reste de cette disposition d’arbitrage demeure en vigueur et doit être interprété conformément à ses conditions comme si la disposition invalide, inapplicable, illégale ou conflictuelle n’y était pas contenue. Toutefois, si la partie qui est jugée comme étant invalide, inapplicable ou illégale est que les réclamations ne seront pas arbitrées selon une base collective ou par représentation, alors l’intégralité de cette disposition d’arbitrage sera nulle et non avenue, et ni le demandeur ni le Promoteur ne pourra demander l’arbitrage de leur litige. Lors du dépôt d’une demande d’arbitrage, toutes les parties à cet arbitrage ont le droit de découverte, laquelle découverte aura lieu dans les soixante jours suivant la demande d’arbitrage, sauf si un tel délai est prolongé d’un commun accord entre les parties. L’ARBITRAGE DES LITIGES EN VERTU DU PRÉSENT PARAGRAPHE SERA EN QUALITÉ INDIVIDUELLE DU PARTICIPANT ET NON EN QUALITÉ DE DEMANDEUR OU MEMBRE D’UN RECOURS COLLECTIF DANS TOUTE PROCÉDURE COLLECTIVE OU PAR REPRÉSENTATION ENVISAGÉE.
